Terms & Conditions

Section 1 Area of application

These General Terms and Conditions (GTC) apply to all contracts entered into by customers (individuals or tour operators) (hereinafter referred to as “Customers”) with

(hereinafter referred to as “MEISSEN”)

regarding the provision of services such as guided tours, events, gastronomic, musical or other tourist services (“tourist services”) (public or exclusive) provided jointly by Staatliche Porzellan-Manufaktur Meissen GmbH and Meissen Porzellan-Stiftung GmbH at the location of MEISSEN at Talstraße 9, 01662 Meißen (“location”) at the time the contract is entered into.

These GTC also apply if MEISSEN confirms the booking of a customer while being aware of the customer’s own General Terms and Conditions.

Conflicting, deviating or supplementary General Terms and Conditions will only be recognized by MEISSEN by way of expressly consenting to such. In general, such General Terms and Conditions are objected to.

Section 2 Registration / Entering into a contract

Registration for a tourist service (offer regarding entering into a contract for a tour, event, gastronomic, musical or other tourist service) may be made via the visitor centre, online via the web shop at www.erlebniswelt-meissen.de or also via the weekday box office of MEISSEN.

Accepting an offer regarding entering into a contract for tourist services by MEISSEN constitutes a contract regarding the tourist service with the customer.

If MEISSEN accepts the offer of a customer regarding entering into a contract for a tourist service, no additional signature of a customer on a contractual document is required.

§ 3 Anmeldungsvoraussetzungen für einzelne touristische Leistungen

Registration for a visit to the exhibition workshop with audio guide and subsequent individual visit to the museum is only required for a group of persons of 10 and more and is made in writing (by email: museum@meissen.com, fax: +49 3521 468 804 or using the booking form at www.erlebniswelt-meissen.de) via the visitor centre of MEISSEN. Individual guests and small groups (less than 10 persons) may purchase tickets for the guided audio tour online via the web shop (see Section 2) or via the weekday box office of MEISSEN.

Tickets for public tours with a guide through the exhibition workshop can only be purchased via the weekday box office or the web shop at www.erlebniswelt-meissen.de. Ticket reservations for public tours are not possible.

Exclusive tours with a guide through the exhibition workshop and the museum are only carried out upon request. Registration is exclusively made in writing (by email or fax or using the booking form at www.erlebniswelt-meissen.de) via the visitor centre. The scheduling of the guide is exclusively made via the visitor centre. It is possible to request a certain guide who will then guide the group as soon as such guide has a license as tour guide for the requested service and his availability is determined in the registration for the service. A retroactive registration of a requested guide is not possible.

Exclusive tours with a guide are offered for groups of 15 persons or more. It is possible for fewer guests to register; however, this carries the following minimum rates: EUR 255 for exclusive tours in German and EUR 300 for exclusive tours in a language other than German. If the majority of the tour participants are eligible for a discount (students or severely disabled persons with a degree of disability of at least 50%) a discounted rate of EUR 195 may be charged. These minimum rates are binding. Reservation of an exclusive tour for less than the stated minimum rates is not possible regardless of the proof of eligibility for a discount of the individual participants. However, when participating in a tour using an audio guide such proof of eligibility is always taken into consideration

Tickets for all gastronomic, musical and package events as well as for other tourist services for individual guests and small groups (less than 10 persons) may be reserved and purchased online via the web shop, via the local weekday box office (subject to availability) or after written registration via the visitor centre.

Group reservations (10 persons and more) for all gastronomic, musical and package events and other tourist services are exclusively made via the visitor centre.

An offer regarding entering into a contract for all tourist services is only accepted and processed by MEISSEN if the customer provides a billing address as well as a phone number with the registration.

Section 4 Prices, cancellation and refund of payments

The prices of the price list that is applicable at the time of registration shall be valid for the time of visit for tourist services of MEISSEN (see also: www.erlebniswelt- meissen.de).

Changes regarding number of persons for tours using an audio guide remain free of charge until including the day of provision of service.

For tours with a guide, changes regarding the number of persons remain free of charge also until the day of the visit, unless such changes pertain to a decrease or increase in group size as well as minimum rates.

Tickets for public tours cannot be rebooked for another date nor cancelled nor returned.

For tourist services with gastronomic part, a cancellation is expressly not possible but only a rebooking for another date.

If a contract is entered into via the web shop at www.erlebniswelt-meissen.de there is no entitlement to a change of date or cancellation.

This applies to all ticket purchases made via the web shop, regardless for which tourist service.

The first change of date of all group registrations (for audio guide tours, exclusive tours or gastronomic or other tourist services) remains free of charge for the customer. Starting with the second change of date, a processing fee of EUR 3.00 per rebooking is due for payment to MEISSEN.

All changes of dates and cancellations must be made in writing or text form (email or fax) and are free of charge until 10 business days prior to the agreed upon day of visit (the day of visit is not included).

After expiration of such a period, the following cancellation fees are charged:

Visit to the exhibition workshop with sound: EUR 1.00 per blocked spot
Exclusive tour with a guide: EUR 90.00 per group (up to 30 persons)
Events with gastronomic part: 100% of the agreed upon costs

Section 5 Consequences of nonattendance or delay of customers

Events for which a contract was entered into and for which there is no cancellation in writing must be fully paid for if the customer(s) does/do not attend.

If a customer is delayed by more than 30 minutes for a tourist service that was booked for a fixed time, his entitlement for the provision of services in line with his booking no longer applies.

Section 6 Payment

Tourist services are paid in general by the customer at the location prior to the fulfilment of the respective tourist service.

Subsequent payment on invoice is also accepted by MEISSEN, however, only if the customer presents a cost absorption declaration (voucher) at the day of the visit containing the billing address, the contact person and email address for the invoice. If no voucher is on hand, the service must be paid at the local weekday box office. If the MEISSEN visitor centre prepares a replacement cost absorption declaration, a processing fee is charged (see Section 4).

Section 7 Mailing expenses

Standard mailing of all contractual documents and tickets is done via email.

If a customer requests for contractual documents or tickets to be sent via postal service in deviation from the standard, a fee of EUR 1.50 will be charged, payable to MEISSEN.

Section 8 Special arrangements for groups

For exclusive tours with a guide and group visits with audio guide, for every 20 participants max. one (1) tour guide or bus driver shall receive free admission. Additional tour guides or bus drivers shall pay the rate per person applicable at the day of visit for the service booked by the group.

For services including a gastronomic part, the tour guide and the bus driver shall pay the full price for the service. .

By way of derogation, for student groups, per 10 participants one (1) escort may accompany the group free of charge, provided that such person has the duty of supervision during the entire stay of the group with MEISSEN.

Groups of severely disabled guests (category “B” in a German handicapped ID) may be accompanied by as many tour guides as needed.

Section 9 Liability

For the provision of services in line with events, MEISSEN shall be liable for intent and gross negligence. For simple negligence, MEISSEN is only liable in the event of injury to life, body, health or in the event that an essential contractual duty is violated. Essential contractual duties are duties whose fulfilment is required in order to achieve the goal of the contract and on whose fulfilment the customer has trusted and was also able to trust.

In the event of a slightly negligent violation of essential contractual duties, liability of MEISSEN is limited in terms of monetary amount to the foreseeable, typically occurring damage.

The aforementioned limitations of liability also apply in favour of the legal representatives and vicarious agents of MEISSEN.

Liability according to the Product Liability Act remains unaffected.

Section 10 Final provisions

The laws of the Federal Republic of Germany, excluding United Nations convention on Contracts for the International Sale of Goods, apply to all contracts between MEISSEN and the customer and contracts between Meissen Porzellan-Stiftung GmbH and the customer.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. Applicable statutory provisions shall apply instead of the invalid provision. This also applies accordingly for the filling of potential regulation gaps in these GTC.

The house rules of MEISSEN and of Meissen Porzellan-Stiftung GmbH apply, which are expressly accepted by entering into a contract regarding tourist services. Dogs are expressly not allowed on the premises of Meissen Porzellan-Stiftung GmbH and in the exhibition workshop.
